Appeal

Attorney Shapiro handles appeals before the Board of Immigration Appeals (BIA) and the First Circuit Court of Appeals. Legal fees are billed at $250/hour and generally range from $5,000-$10,000.

Board of Immigration Appeals

  • The BIA is able to hear appeals of Immigration Judge denials.
  • Appeals must be filed within 30 days of the Immigration Judge’s denial.
  • A stay of removal is automatic if based on the merits. If the appeal is not based on the merits, a stay of removal is needed.
  • Timeframe: Detained cases are decided in about 3-4 months and Non-detained cases can take over a year.

First Circuit Court of Appeals

  • The First Circuit hears appeals of BIA decisions.
  • The appeal must be filed within 30 days of the BIA decision.
  • A stay of removal is not automatic.
  • Timeframe: It is common for the case to be pending for well over one year.
